Terms & Conditions 

By ordering from Gratificaketion, you agree to the following Terms & Conditions. It is your responsibility to fully read and agree to the Terms & Conditions set out by Gratificaketion before ordering. Gratificaketion will not be held liable for any error or mis-judgements made by the consumer.

These terms form the basis of the contract between our customer & Gratificaketion. 

These Terms, your Order and your Order confirmation are considered by us to set out the whole agreement between you and us for the sale of the products. It is your responsibility to check all details in the order confirmation are complete and accurate as this is the specification we work to when completing your order.

Basic of Sale 

Payment is needed to confirm in-person, online and telephone orders and until payment is received your order cannot be guaranteed. No contract is made with you until we have received your payment or booking free. Once your payment or booking fee has been received you are in a legally binding contract with Gratificaketion. We reserve the right to cancel any order still awaiting payment on the delivery date. Your order will remain payable in the event of cancellation or postponement because we may have had to turn away other clients and start preparations for your order.


Any samples, drawings, photos or descriptions we issue and any descriptions or illustrations contained on our website are issued solely to provide you with an approximate idea of the products they describe and remain the property of Gratificaketion.

Cake quotations are valid for a period of 30 calendar days from the day of issue. Cake sizes quoted are in inches.

 

Cakes are bespoke and, therefore, prices vary dependant on size, flavour, decoration, design, time and equipment used. Gratificaketion reserves the right to alter prices at any time as we see fit. Any pre-paid price for cakes before price alterations will remain as agreed.

 

Personal information given to Gratificaketion upon ordering products will remain private and confidential. 
 

The Products

Our products are made in a home kitchen environment where Nuts, Egg, Milk, Wheat, Gluten, Soya and other Allergens are present. We cannot guarantee that any product is Allergen Free and, therefore, do not take Allergy Free orders. Gratificaketion will not be held liable if you have ordered products containing ingredients that you cannot consume given that ingredients & allergens are listed. 


We warrant that on delivery or collection, Gratificaketion products shall conform to their description as set out in the Order Confirmation, be of satisfactory quality and comply with all food safety, statutory and regulatory requirements in the UK. We will not be held responsible for customer disappointment of the design or the interpretation of the goods as long as it is made in line with the customer’s pre agreed requirements set out in the order confirmation and Gratificaketion will face no consequent liability. It is the customers responsibility to ensure all details within the order confirmation are correct and meet their exact requirements.


The warranty does not apply to any defect in the Cakes or Gratificaketion goods arising from wilful damage, accident, negligence by you or any third party, if you use the product in a way we do not recommend, your failure to follow our instructions or any alterations you carry out.

We cannot guarantee an exact replica of any cake or good but we will do our best to make it so. Where colour swatches are provided we will do our best to match as close as we deem possible. Exact colour matches are not guaranteed.

If flowers are provided by an outside source, we will place them for an additional fee. You acknowledge that fresh flowers are not a food product, and may contain pesticides, insects, dirt, or other contaminants and must be removed along with any floristry tape and wire before consuming the cake.

From time to time certain materials for our cakes and products may become obsolete. This is totally out of our control; however we will do our best to select replacement products to reflect the original design as closely as possible. We reserve the right to replace items with component parts of equal or better quality without consultation.

If your cake contains figures made from sugar paste, whilst edible, we do not advise that they be eaten, due to the possible presence of dowels for reinforcement.

Stacked cakes contain dowels in each tier to provide support and these should be removed before consumption.

All goods are fresh containing no additives or preservatives and it is our right to assume consumption on the day requested. Cakes and goods should be stored in the refrigerator, away from direct sunlight and sources of heat in the box/packaging provided.

Gratificaketion and the customer expressly agree that the cakes and all goods purchased from Gratificaketion remain the property of Gratificaketion until paid for in full.

Whilst the majority of our treat goods can be made within 48 hours, particular products require at least 3 days notice prior to dispatch. Cookies take 72 hours to make, develop and deliver. 

Delivery & Collection

ALL products need at least 48-72 hours to be made to order before being dispatched, with most products needing 72 hours plus for ordering of supplies, making & developing time and packaging before dispatch. This is stated in our Shipping Information on the individual product pages. It is your responsibility to order in advance of the date you need the products delivered for.

Gratificaketion only delivers to addresses within the United Kingdom. We cannot post goods internationally. 

It is your responsibility to check and make sure all your delivery details are correct before paying for the goods. Gratificaketion will not be liable nor take responsibility for any misplaced postal items if details are not fully complete or correct nor will you be entitled to any refund, exchange or credit. 


All orders may be collected free of charge from Gratificaketion by prior arrangement.

Once goods have left our bakery we can not be held liable for any damage that occurs on transit. Any issues should be handled directly with the courier company you have chosen to use. We accept no responsibility for any damage sustained to the cake or goods once it has left the premises.

If delivery has been requested we will deliver the cake or goods on the day set out in the order confirmation to the address provided. We do not offer specific delivery times. Gratificaketion will always do the best it can to ensure delivery dates agreed are achieved for the provision of the goods or services however the Company cannot accept liability for delays and time shall not be of the essence.
 

Once the cake or goods have been delivered we are unable to accept any liability for any damage sustained to the cake thereafter nor any failure to follow the instructions provided.

 

Orders are shipped with Royal Mail. Only select goods are available to be posted and it is your responsibility to check which items can be posted.  Gratificaketion reserves the right to decide which day goods are posted. You are given the offer of First Class (1-2 days), Tracked 24 (Next Day) or Tracked 48 (2 Days). With all items needing AT LEAST 48 hours to be made (this can vary depending on schedule), if you need items soon, it is highly recommended you pay for Tracked 24. 

Please note there may be delivery delays due to Coronavirus and additional pressure on delivery service at this time. Gratificaketion will not be held liable for strikes conducted by Royal Mail and, therefore, Gratificaketion will post out the following week after the strikes end. It is your choice to either pay extra for another postal service (DPD, Evri, etc...) or choose to wait. Once again, please note that time shall not be of the essence and Gratificaketion reserves the right to choose the day of postal. The responsibility of checking dates & delivery relies upon the consumer.

I am a small business (one person to be exact) and create everything from scratch so it is fresh & bespoke to your order. This means my schedule is dictated by my other jobs plus the need to order in supplies, make, package and send out your order. 

Any delays do not entitle you to any free/complimentary products nor refunds as it is your responsibility to order well in advance of the date you require the items for. 

Gratificaketion reserves the right to refuse an order if these terms are unsuitable to you or you break this contract. 

Price & Payment

The price of your goods will be as set out in your order confirmation. No Vat is payable on the products. A £10 booking fee is required for all cakes.

Please note all booking fees are non-refundable and non-transferable.

The balance must be paid in cleared monies no later than the date set out in the order confirmation by bank transfer to the account specified or cash. Late payments will incur a £25 charge.

If payment is not received by the date specified this shall be constituted as breach of contract by the client. We reserve the right to hold the order until payment is made in full. When payment is late we accept no responsibility should we be unable to purchase the required stock or equipment to make the cake as laid out in the order confirmation. In these circumstances the cake and products will be made as close to the order confirmation as possible with no redress or liability on Gratificaketion.

 

All our goods are baked to order and we do not accept returns. Refunds, credit notes or a replacement order to the same value will be given only in the event that you receive the incorrect product or if the products are shown to be of unsatisfactory quality. Should this be the case, or if you are in any way unsatisfied with the condition or quality of your cakes upon arrival you must contact us within 24 hours of receipt. Gratificaketion will not accept liability for any complaints made after this time. 

No refunds, credit notes, exchanges or replacements will be given if the consumer/customer breaks this contact or decides after ordering not to follow the T&Cs as laid out. 

Cancellations, Postponement & Alterations 

If you need to change the date or details of your order or cancel it altogether please contact us as far in advance as possible.

 

In the event of a cancellation by yourselves, charges are as follows;
Any payments previously made are not refundable.

In the event of a postponement, the payment due remains the same as a cancellation. Subject to availability we will carry the monies paid forward to the new date. Please be aware that we will only do this on one occasion. Any further postponements will be classed as a cancellation.

You may, prior to 4 weeks for celebration cakes, amend or cancel your order by providing us with written notice. In the case of alterations a new order confirmation will be issued detailing the changes and the new cost. Alterations are not confirmed until a new order confirmation has been issued. Should you make any changes after that time there will not be a reduction in the price you pay, even if your new design is cheaper than the original booking.

In the unlikely event that we need to cancel your order any monies paid will be refunded. Gratificaketion reserves the right to cancel, vary or suspend the operation of this contract if events occur which are in the nature of force majeure including (without prejudice to the generality of the foregoing): fire, floods, storm, plant breakdown, strike, lock outs, riot, hostilities, non-availability of materials or supplies or any other event outside the control of Gratificaketion, and Gratificaketion shall not be liable for any breach of contract resulting from such an event. No refunds, credit notes, exchanges, free/complimentary products will be given as compensation for delay. 

Gratificaketion liability (both in contract and tort) in respect of defects in goods or services shall be limited to the issue of a credit note in respect thereof or granting a refund or other such compensatory measures as Gratificaketion, at its discretion, considers appropriate in the circumstances and shall be limited to the value of the goods or services giving rise to the claim.

Complaints

Complaints are very rare and due to the amount of work put into each individual good & cake, I take them very seriously. Any issues must be bought to my attention with 48 hours on collection or delivery to give fair opportunity to assess the nature of the complaint.

Both Parties agree to not post any negative information about the other arising out of this Contract or Event on any online forum or website. Both parties must provide the other party with the opportunity to resolve any issues between the parties amicably.

Complaints regarding the decoration of celebration cake can be repaired so errors of this nature must be pointed out upon delivery/collection so as to give us the opportunity to correct them. Once payment has been handed over this confirms that decoration is as requested and no further claims can be made.

Where the complaint is in regards to the quality of the goods then the goods, or remainder of the goods, must be returned to us as soon as possible after cutting and within 48 hours of collection/delivery to ensure that we are able to fairly assess the nature of the complaint.

Please note I only deal with the client who placed the original order.

General Terms

All designs and intellectual property rights remain the property of Gratificaketion.

We reserve the right to use images of orders we prepare for any form of advertising including Website, Instagram pages, Facebook Pages, Tik Tok, web based promotions, brochures, galleries and competitions. It is advisable that you make a copy of all documentation received from Gratificaketion for your own benefit.

This Agreement together with Order Confirmation documents provided constitute the entire agreement and understanding between the parties relating to the order. Except as may be expressly stated in this Agreement, it supersedes and cancels all prior agreements, statements, representations, understandings, negotiations and discussions, whether oral or written, between the parties. Each of the parties acknowledges and agrees that in entering into this Agreement it does not rely on any statement, representation, warranty or understanding made prior to this Agreement save to the extent that such statement, representation, warranty or understanding is incorporated into this Agreement. Each of the parties acknowledges and agrees that in entering into this Agreement it has not relied on (or has been induced to enter into this Agreement by) any statement, representation, warranty or understanding made prior to this Agreement. Nothing in this paragraph excludes any liability for fraudulent misrepresentation.

In the event that any one or more such provisions of this Agreement should be deemed to be invalid or unenforceable, such invalidity or unenforceability shall not affect the validity and enforceability of the remaining valid and enforceable provisions thereof which shall be construed as if such invalid or unenforceable provisions had not been inserted.

The parties agree to submit to the non-exclusive jurisdiction of the English courts.

Any headings utilised in this Agreement have been inserted for the convenience of reference only and should in no way restrict or otherwise affect the construction of the terms and conditions here of.
